Dear Rabbi Flom,
I have totally disagreed with a friend of mine about returning clothes. She wore an article of clothing and told me she didn't like it, and, even though she wore it, was returning it to the store. I told her that just wasn't right - if she didn't like it, she shouldn't be wearing it. I lost that argument though.

Also, when I graduated, I had a gorgeous dress shipped from out of town. When it arrived, there was a tear in the material, and this was just a few days before graduation so I had no choice but to wear it. After graduation, I took the dress back where it was purchased and asked them to repair it. I told them that I did wear it. Instead, the store insisted on taking it back and gave me the credit. Now, that was some store. Is this the same situation that you described?

Part of the key to these laws are "deceit". If I really like the item and I wear it, and didn't have intention of buying it (my case) that is certainly stealing. Actually, your "graduation gown" story, is very interesting. They certainly were very good, as a matter of fact, I'm not sure why they didn't just fix it.My daughter bought a dress for a wedding, and 20 minutes before going, she noticed that the dress had a rip that was sown. She wore the dress, because, as you said "had no choice but to wear it". I asked a Posek, if she could get the full refund, even though she wore it, and he said "yes".
