In the beginning of Baba Metziah, we try to find a kal v'chomer to support Rav Chia's din that eidim can be mechayev a 'modeh bemiktzat' to swear. So how can the gemorah later on try to learn it from a Tzad HaShaveh? (Same question in Kidushin with Rav Huna and "Chupa konah mikal v'chomer"...)

Thanks, but you must've misunderstood my question. I meant that if we said it is learnt from a kal v'chomer, what's the hava amina to try to learn it from a tzad hashaveh? (It may seem like a silly question, but my rebbe said he saw it in an Achron that ended up with a 'tzarich iyun'. My rebbe couldn't remember who it was that said it...)
