ok..im looking for psak halacha on kohanim going to machpelah.
this is how i understand the situation as of now: its a machlokes as such: ussur, because they found bones of hediot.
mutar, because of (i forget the expression, pardon me) the tuma is trapped and does not go up into the building, because the bodies are in a cave.
so here is my question: why should we be afraid of tuma there anyways? the avos are before matan torah, are not halachachly jewish, thus al pi svara, are not tumay meis. tumas tahoras is only after matan torah.
but anyways, i guess if there were bones hediot laying around, then it would be ussur...so does anyone know of any psak coming out of chevron on this?

In response about the the Avos where before Matan Torah, we see that on BB 58a that R'B'nah was marking the Maros Hamachpalah for Tumah. Tosfos over there says you can't exclude them from being M'tameh Bu'ohel like non-jews from "Adum", since he was called "Adum Hagudal". Also, Adam Harishon was, kind of, called Adum.

very good...i actually found that source today..and it refers you back to a tosfos in yavamos...over there, tosfos says they arent mutamay ohel. lamysa...r'b'nah, did mark the kever. but the building could might be suitable to stop the tuma if there is tuma...anyways,ty...i think i need to get psak from someone in chevron, about the building and if there are bones hediot there.

It would seem that the Tosfos in BB is the Maskunah of Tosfos (this was written as the answer to the question.)
